1.1. Misteria Vale (hereinafter the "Game") is a browser detective game in which the characters talk with the player "live": their lines and the related in-game texts are produced by artificial-intelligence technologies (hereinafter "AI"). It is AI that makes the characters feel alive — and that is exactly why their words must not be taken as facts.
1.2. This Policy explains which functions AI performs in the Game, what its limitations are, how requests to it are processed, and what is prohibited when using it.
1.3. The Policy is an integral part of the Game's set of documents and applies together with the Public Offer (/legal/offer/), the Terms of Use (/legal/terms/) and the Personal Data Policy (/legal/privacy/). The terms "Game", "Account", "Mana", "Package" and "AI agent" are used with the meanings given to them in the Public Offer.
2.1. AI agents in the Game perform the following functions:
2.2. AI agents are game characters, not consultants, support operators or representatives of the Seller. Nothing said by a character in the Game constitutes a statement or an undertaking of the Seller.
2.3. Character lines and other texts created by AI agents as part of the Game form part of the Game's content; the rights to such generated content are determined by the Terms of Use (section "Rights to content"): they belong to the Seller to the extent permitted by law, and the User is entitled to use the generated content within the Game for personal non-commercial purposes.
3.1. All answers of AI agents are works of fiction created within the Game's plot.
3.2. Answers may be inaccurate, self-contradictory and plausibly false: a character may state with confidence things that are not true — both inside the game world (by the plot, characters may be mistaken or may lie) and outside it.
3.3. The Seller does not warrant the accuracy, completeness or consistency of the generated text.
4.1. The User is obliged to assess any answers of AI agents critically and not to rely on them as a source of accurate information.
4.2. Answers of AI agents do not constitute advice or a recommendation of any kind — including legal, medical, financial, psychological or other professional advice. For real-life matters, please consult qualified specialists.
4.3. A short note is placed in the dialogue window stating that characters' answers are generated by AI and are a work of fiction. Sections 3–4 hereof describe the properties of the functionality provided (Article 10 of the Law of the Russian Federation "On the Protection of Consumer Rights") and do not limit the Seller's liability established by law.
5.1. When interacting with AI agents it is prohibited to:
5.2. A breach of these prohibitions is a breach of the Terms of Use and may entail the measures provided for therein, including restriction of access to the Game's functions and blocking of the Account.
6.1. The Seller is entitled to apply automated and manual means of moderation: to filter requests and answers, to reject individual requests, and to restrict the subject matter of the generated content.
6.2. The model provider's own moderation tools (see section 7) may likewise reject a request or alter the character of an answer; this is a normal part of how the service works and not a malfunction.
6.3. The Game is intended for an adult audience (information product mark — 18+): the plot is a detective story with dark themes, and the generated content may match them. The Game is not intended for minors.
7.1. AI models of Google (the Gemini API) are used to generate answers. The text of the User's messages to AI agents, together with the necessary game context, is transferred to the provider's servers for processing. The game context is composed by the Game (the Seller) and contains no personal data of the User.
7.2. The data transferred is minimised: the requests to the models do not include the User's email, surname, given name or Account identifier. The User should not tell the Game's characters personal data, whether their own or another person's — the content of messages is transferred to the provider as it is.
7.3. The provider's servers may be located outside the Russian Federation; such transfer is cross-border and is carried out on the basis of the performance of the contract with the User, in compliance with the procedure established by personal data legislation; no separate consent of the User is requested for it. Further detail on data processing in the operation of the Game is in the Personal Data Policy (/legal/privacy/).
7.4. Use of the models is also subject to the provider's (Google's) terms and acceptable use policies, links to which are given in the Terms of Use.
8.1. The User's requests to AI agents and the generated answers are kept in the Game's log.
8.2. Purposes of storage: operation of the service (maintaining dialogues and game progress), charging of in-game actions in Mana, handling Users' support enquiries and disputes, moderation and prevention of abuse.
8.3. Retention periods and the procedure for deletion are determined by the Personal Data Policy.
9.1. The Seller is entitled at any time to replace the AI models used, their versions and their settings without prior notice to Users.
9.2. Replacing a model may change the style, quality and character of the characters' answers. Replacement is carried out with the Game's functionality preserved; variability in the style and character of answers is a property of the functionality provided, and preservation of the previous behaviour of any particular model is not guaranteed.
10.1. In-game actions that use AI (for example, obtaining a character's answer) consume Mana, an in-game resource. Mana is charged for the action actually performed.
10.2. The cost of individual in-game actions in Mana may change, including upon replacement of models or a change in the cost of using them. This corresponds to the properties of Mana set out in the Public Offer: the price of Packages and the cost of individual in-game actions may change.
10.3. A change in the cost of actions applies only to actions performed after the change; it does not revise charges already made and does not apply to actions already begun or paid for. Users are notified of changes in advance in the Game and on the website. The indicative cost of actions is communicated to the User in the Game's interface; the charge is made for the action actually performed. A User who does not agree with a change is entitled to obtain a refund of the price of unused paid Mana under the Payment and Refund Policy.
11.1. The Seller does not guarantee the constant availability of any particular AI model or the uninterrupted operation of the Game's AI functions: their operation depends, among other things, on an external provider.
11.2. If an in-game action was not performed because of a failure (including an error of the external API), the compensation rules provided for by the Public Offer and the Payment and Refund Policy apply: repeat provision of the result, restoration of the Mana charged, or a refund of the corresponding part of the sum paid. The provisions of this section describe the properties of the service and do not limit the User's rights as a consumer established by law.
12.1. The Seller is entitled to amend this Policy. Each edition has a version number and an effective date; previous editions are kept in the archive on the website. The version of the Policy in force at the moment of purchase is recorded in the order (by order number) at the moment of acceptance.
12.2. Please send questions on this Policy to support@misteriavale.com; when enquiring about a particular purchase, quote the order number. First response within 3 working days.
12.3. The Policy is drawn up in Russian. Where a translation into another language appears, the Russian version prevails: the translation is for reference only and does not create rights or obligations of its own.
*The version of the document is recorded in the order at the moment of acceptance. The archive of editions will appear together with the first edition in force.*
